Minutes:

The Chair introduced the Members of the Sub Committee and welcomed everyone to the hearing.

 

The Chair stated that agreement had been reached between the applicant and the NBC Environmental Health Service at 8pm on Thursday 20th September 2012.  As this was less than twenty four hours prior to the Sub-Committee meeting the hearing was legally required to go ahead in accordance with The Licensing Act 2003 (Hearings) Regulations 2005 and associated S182 Licensing Act guidance.

 

The applicant did not attend the hearing.

 

As such there were no presentations by or questions to either the applicant or the representor of the objection.

 

The application was to vary the current premises licence.

 

 

The Determination

 

The application was granted in full with the following conditions:

 

·         The access doors shall be overhauled so they fit properly and butt evenly against the doorstops.  Any holes shall be blocked up and gaps filled.  The doors shall be provided with compression seals (draught-stripping) to make the doors as air-tight as possible.

·         Access and egress from the front and rear should be controlled by doormen after 23.00 hours.

·         The rear yard shall not be used after 23.00 hours.

  • The PA system shall be controlled by a compressor-limiter device set such that the music is inaudible at the locations marked in red on the attached plan in Wellingborough Road and St Edmunds Road.
  • The chiller units shall be maintained in an operable condition so that reasonable temperatures can be maintained in the premises with the doors shut.

 

 

All parties had the right to appeal the Sub-Committees decision to the Magistrates Court within 21 days of the date of the decision.
