Minutes:

Apologies were received from Councillors Malpas and Mennell, and from Councillors Conroy, Marriott and Stone for the afternoon session (when items 9 and 10 were considered).

Minutes:

Private Hire drivers and representatives were given leave to address the Committee as set out in the confidential part of these minutes.

Declarations of Interest

Minutes:

Councillors Conroy, Hill, Larratt, Marriott, Sargeant and Stone declared personal, non-pecuniary interests in minute 7 as they knew the Private Hire driver’s representative.

Matters of Urgency which by reason of special circumstances the chair is of the opinion should be considered

5.

Exclusion of Public and Press

The Chair to Move:

“that the public and press be excluded from the remainder of the meeting on the grounds that there is likely to be disclosure to them of such categories of exempt information as defined by section 100(1) of the Local Government Act 1972 as listed against such items of business by reference to the appropriate paragraph of Schedule 12a to such act.”

Minutes:

The Chair moved that the Public and Press be excluded from the remainder of the meeting on the grounds that there was likely to be disclosure to them of such categories of exempt information as defined by Section 100(1) of the Local Government Act 1972 as listed against such items of business by reference to paragraph 1 of Schedule 12A to such Act.

 

The Motion was Carried.

Application for a Private Hire Driver's Licence

Minutes:

The driver confirmed that he had received the relevant paperwork and the Senior Licensing Officer outlined the circumstances as set out in the report.

 

The Committee heard the representations made and reached a decision with regard to any further action to be taken.

 

RESOLVED:

 

That the application for a Private Hire Driver’s Licence be refused.

7.

Private Hire Driver - Breach of Licensing Law

Minutes:

Councillors Conroy, Hill, Larratt, Marriott, Sargeant and Stone declared personal interests as they knew the Private Hire driver’s representative.

 

The driver confirmed that he had received the relevant paperwork and the Senior Licensing Officer outlined the circumstances as set out in the report.

 

The Committee heard the representations made and reached a decision with regard to any further action to be taken.

 

RESOLVED:

 

That the driver’s Private Hire Badge be suspended until 7th March 2015.

8.

Application for a Private Hire Driver's Licence

Minutes:

The driver was not present and no reason was given for their absence.  The Senior Licensing Officer confirmed that the driver had been notified of the date of the meeting, been served with the relevant paperwork and informed that the application would be considered even in the absence of the driver.

 

The Committee considered the report and the statement made by the Senior Licensing Officer and reached a decision with regard to any further action to be taken.

 

RESOLVED:

 

That the application for a Private Hire Driver’s Licence be refused.

9.

Application for a Private Hire Driver's Licence

Minutes:

The driver confirmed that he had received the relevant paperwork and the Senior Licensing Officer outlined the circumstances as set out in the report.

 

The Committee heard the representations made and reached a decision with regard to any further action to be taken.

 

RESOLVED:

 

That the case be deferred until the next meeting of the Licensing Committee, on 22 July 2014 to allow further information to be collected in order to make a decision.

10.

Private Hire Driver - Breach of Licensing Law

Minutes:

The driver confirmed that he had received the relevant paperwork and the Senior Licensing Officer outlined the circumstances as set out in the report.

 

The Committee heard the representations made and reached a decision with regard to any further action to be taken.

 

RESOLVED:

 

That the Private Hire Driver’s Licence be suspended for two months.
