RESOLVED:(1) That Mr A Kalam be granted leave to address the Committee in respect of item 9 “Review of a Private Hire Driver’s Licence”.

(2) That Mr J Mataire be granted leave to address the Committee in respect of item 11 “Review of a Private Hire Driver’s Licence”.

Matters of Urgency which by reason of special circumstances the chair is of the opinion should be considered

The Chair was of the opinion that the following be discussed as Matters of Urgency due to the undue delay if consideration of them were deferred:-

 

(1)            GAMBLING ACT TRAINING – 30 SEPTEMBER 2009.

The Chair reminded members that training on the Gambling Act were scheduled for 30 September 2009 and asked for an indication of those who would be attending.

RESOLVED:That it be noted that all the Committee members would be attending the Gambling Act training on 30 September 2009.

 

(2)         ILLEGAL PLYING FOR HIRE.

The Licensing Officer reported that all private hire operators had been written to advising them that further checks of plying for hire were scheduled and that they should advise their drivers accordingly.  Any drivers subsequently caught plying for hire would be dealt with severely.

RESOLVED:         That the position be noted.

Minutes:

The Licensing Officer submitted a report that set out the removal of the requirement for the designated premises supervisor and personal licence at community premises under Section 182 of the Licensing Act 2003.

RESOLVED:                        That the report be noted.

The Licensing Officer submitted a report in respect of the introduction of a simplified process for minor variations to premises licences and club premises certificates under Section 182 of the Licensing Act 2003.

RESOLVED:                        That the report be noted.

The Chair to Move:

“that the public and press be excluded from the remainder of the meeting on the grounds that there is likely to be disclosure to them of such categories of exempt information as defined by section 100(1) of the Local Government Act 1972 as listed against such items of business by reference to the appropriate paragraph of Schedule 12a to such act.”

The Chair moved that the Public and Press be excluded from the remainder of the meeting on the grounds that there was likely to be disclosure to them of such categories of exempt information as defined by Section 100(1) of the Local Government Act 1972 as listed against such items of business by reference to the appropriate paragraph of Schedule 12A to such Act.

 

The Motion was Carried.

Review of a Private Hire Driver's Licence

Minutes:

The Committee heard the representations made and reached a decision with regard to the suspension or revocation of a driver’s Private Hire licence based on the evidence presented.

RESOLVED:That the Private Hire licence be suspended for a period of three months.
